Product Purpose: The GHOST product has been meticulously developed with the intention of reducing the risk of vehicle theft and providing peace of mind to its users.
Installation and Usage: While GHOST South Africa strives to provide accurate installation instructions and guidelines, it is important to note that the responsibility for the proper installation and usage of the product lies solely with the entity performing the installation. GHOST South Africa does not assume any responsibility for errors, omissions, or negligence in the installation process.
Limitation of Liability: GHOST South Africa explicitly states that it will not be held liable for any claim of whatever nature or from whatever cause arising from the installation, usage, or malfunction of the GHOST product. This includes, but is not limited to, claims for damages, losses, injuries, or any other form of liability, whether direct, indirect, incidental, consequential, or punitive.
User’s Obligations: Users of the GHOST product are responsible for ensuring that they have thoroughly read and understood the provided instructions, user manuals, and any accompanying documentation. It is the user’s obligation to follow the recommended guidelines for installation, activation, and usage of the product to ensure optimal performance and minimize any potential risks.
Professional Installation: GHOST South Africa will only allow for the services of qualified professionals for the installation of the GHOST product. While the company may provide a list of authorized installers or technicians, the selection and engagement of any such professionals remain the sole responsibility of the user. GHOST South Africa does not guarantee the quality or performance of any third-party installation services.
Indemnification: By using the GHOST product, the user agrees to indemnify, defend, and hold harmless GHOST South Africa, its officers, employees, agents, and affiliates from any claims, liabilities, damages, costs, or expenses (including legal fees) arising out of or related to the installation, usage, or malfunction of the product, regardless of the cause.
Severability: If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
Governing Law and Jurisdiction: These terms and conditions shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.
